All private sector landlords of assured shorthold tenancies (ASTs) must place their tenants' deposits in a government-backed tenancy deposit scheme.
Agents can be held liable for failures to protect tenancy deposits and comply with tenancy deposit legislation (Draycott & Draycott v Hannells Letting Limited [2010] EWHC 217 (QB)).
