Summary

In a case concerning a residential letting and the scope and extent of the landlord’s implied covenant under section 11 of the Landlord and Tenant Act 1985, the Court of Appeal held that the internal plasterwork was part of the structure of a building. The nature of the plaster does not matter: it can be substantial lathe and plaster, or a merely smooth constructional finish to walls and ceiling. In doing so, it overruled part of the decision in Irvine v Moran.

The point that problems outside the demise to the landlord himself ought not to be his responsibility has been re-emphasised.
