The defendants, in carrying out a mortgage valuation at a time when the housing market was rising sharply, placed a value of £37,000 on a house that was subsequently held to have been worth only £32,000 on the date of their valuation. Two months later, the claimant purchased the house for £42,000, by which time its actual value had risen to £37,000. The defendants argued that the claimant had suffered no loss but the Court of Appeal upheld the trial judge's decision to award £5,000 damages.
