Summary

The claimant, who had relied on a negligent mortgage valuation in deciding to purchase a house, discovered on moving in that the house was so defective as to be virtually uninhabitable. The Court of Appeal held that the claimant was entitled to recover the cost of alternative accommodation for himself and his family until such time as he could sell the house and acquire another property.

In this case the Court of Appeal confirmed that the measure of damages described above ('difference in value' rather than 'cost of repair') is also the correct one to adopt in cases involving a negligent mortgage valuation.
