The claimant purchased a house for £4,600, having received a report from the defendant that valued it at £4,300. Its true value at the date of purchase (due to defects that the survey should have revealed) was only £3,500. When the claimant brought an action for negligence, it was held that the damages should be £800 rather than £1,100, since the purchaser could hardly be said to have relied on the valuation in deciding to pay an extra £300.
