The defendant valuers advised a bank to accept a revised 'overage' deal in respect of a plot of land that they held as security for a loan. This advice was held negligent, in that the surveyors had taken no steps to check with the planning authority whether the land had development potential. The claimants were held entitled to damages assessed on the basis of a two-to-one chance that, had they not agreed to the amendment, they would have received a much greater payment under the original deal.
