The plaintiffs were instructed by the defendant who was intending to purchase a night club. They were to provide valuations, prepare an inventory of fixtures and fittings, take details of trading figures and generally assist the defendant in negotiations with the prospective vendor (with whom the defendant had already had discussions). After the purchase was completed, the plaintiffs claimed the sum of £5,980 based on the former RICS scale. It was found that there was no express or implied term that remuneration should be on the RICS scale, so the plaintiffs were awarded a sum on a quantum meruit basis. The county court judge calculated that they were entitled to £80 per hour for 45 hours plus VAT - a total of £4,140. This was upheld in the Court of Appeal.
