The defendant agents' employee asked the prospective tenant for a cheque for the deposit and rent in advance. He replied that he had forgotten his chequebook, but would give her a cheque the next day. The employee naively accepted this offer and the tenant was given possession and the keys. The judge held that no agent acting reasonably and without negligence would allow someone in who had paid no deposit or advance rent, unless authorised to do so by the client.
