Summary

Enforcement notices were served in respect of caravans parked in a lay-by owned by the Highway Authority. The caravans were apparently permanent homes. Following Stevens v Bromley London Borough Council, the Divisional Court held that there may be circumstances where squatters can be regarded as occupiers for the purposes of planning legislation. It depended on such factors as the length of time they had been on the site and the use to which the site had been put. In the circumstances the squatters were occupiers.
