The defendant carried out significant demolition and rebuilding works to his house which interfered with the party wall causing damage to the plaintiffs' property. The defendant had not given notice as required by the 1939 Act. The plaintiffs obtained an interlocutory injunction preventing further work without compliance with the Act. The defendant also repaired the physical damage. However, the plaintiffs claimed consequential damages including costs incurred due to their inability to sell the property when they had planned, as a result of the defendant's works. The claim was made for nuisance. The Court of Appeal held that the defendant was liable at common law, in nuisance, since he had failed to comply with the Act.
