Summary

The appellant constructed 2 new external walls to a bungalow. He then sought to build the other 2 walls thereby obtaining a rebuilding of the house without having to comply with the height and size limits imposed on improvements to dwellinghouses under the Town and Country Planning General Development Order 1977. None of the original external walls remained. Part of the floor, the roof and some internal supporting walls remained. The Divisional Court upheld the Secretary of State's decision that the works amounted to the construction of a new dwelling rather than the improvement of the existing one.
