The issue in this case was whether the MetroCentre, a substantial enclosed shopping centre, was the planning unit or whether the individual shops were separate planning units. The Secretary of State regarded each individual unit as occupied in its own right and, therefore, applying the criteria in the Burdle judgment, considered that each unit was, as a matter of fact and degree, the planning unit.
