In a medical negligence case it was held that the judge had acted prematurely in ordering the parties to appoint a named SJE before they had pleaded their respective cases. Each side should be entitled to have its own expert at this stage. While the time might come later for an SJE appointment, until the issues were before the court, it would be premature to make an order as to what experts should be called or to ascertain what duplication existed between them.
