In this case the adjoining owner was awarded legal costs by an award, such costs being pre-issue litigation costs incurred by her in preparation for injunction proceedings which were avoided at the eleventh hour by an undertaking given by the building owner. The Court of Appeal (approving Onigbanjo v Pearson) held that while legal costs were in principle recoverable under the Act, they should be the costs of advice in relation to the Act, not litigation costs.
