It was held that a fax order with a covering letter containing the statement 'I would be obliged if you would forward your costs, once finalised and agreed with [the engineers]' would not be understood by a hypothetical, objective, reasonable bystander to mean that Murray was entitled to the price agreed with the engineers and that the document was insufficient to be a construction contract evidenced in writing' for the purposes of section 107(2)(c) of the Housing Grants, Construction and Regeneration Act 1996.
