The claimant bricklayer contracted to carry out various items of stonework and roofwork to six cottages to be erected on the defendant's land, and brought an action to procure payment from the defendant. In delivering its judgment, the Court held that, notwithstanding the existence of a contractual completion date, completion by such date did not 'go to the essence' of the contract, as the employer could be adequately compensated in damages for any delay.
