The plaintiff and the defendant owned terraced properties. The defendant employed a contractor to demolish his property. The demolition was carried out without shoring up or otherwise supporting the plaintiff's property and damage was caused. The judge decided that an easement of support could be acquired by a building from another building by prescription under the Prescription Act 1832. It was held that both the contractor and the defendant owner were liable for the removal of support.
