Summary

Two prefabricated chimneys were installed by the builder. The architect noticed that the first was installed improperly and warned the builder to correct this. When the second was installed, the same mistake was made by the builder but was covered up before the architect inspected it. The architect made no attempt to make an examination of the second chimney. Because of the faulty installation a fire broke out causing damage.

The court held that since the installation was so critical to safety, and since the architect had already identified a similar fault, the architect was negligent in failing properly to inspect the installation of the second chimney.
