Alhambra wished to undertake work to a party wall and served notice on the occupying tenant on the other side of the wall. However, it failed to serve on Crosby, which was the owner of a 99-year lease in the adjoining property. The court held that every party falling within the definition of 'adjoining owner' was entitled to service of a notice. Where there are co-owners, with a shared ownership of a single legal estate, it is only necessary to serve on one of the co-owners.
