Summary

The plaintiff milling company engaged the defendant architects to prepare plans and a specification for the construction of a feed mill and to supervise the construction works themselves. It was common ground that the plans, if adhered to, would have resulted in a problem-free building. However, the architects failed to supervise the contractors adequately or at all, and a defective belt of concrete was deployed in the substructure of the building during construction. The court had no hesitation in finding the architects liable for negligent supervision.
