The EAT held that the employment tribunal had been wrong in its evaluation of the medical evidence; it had been over-influenced by the evidence of the employers' regional medical officer as to whether the applicant's impairments were 'substantial' for the purposes of the Disability Discrimination Act 1995. The effect was that the tribunal had simply adopted the view of the expert witness instead of making their own assessment.
