The landlord had unsuccessfully opposed the application for a new tenancy on the basis that it intended to occupy the premises itself (ground (g)). The landlord was unsuccessful because it had only been the reversioner for just under the requisite 5-year period. The Court of Appeal held that the judge was right to take into account the fact that the landlord wished to occupy and that it might have to leave its existing premises shortly. The tenant wanted a 7-year term but only a 1-year term was granted.
