The tenants had a lease for almost 10 years, with a break after 5. Rent was payable quarterly in advance on the traditional quarter days. The tenant’s break notice was served properly and in good time. The lease was due to expire on 11 October 2010. A quarter’s rent (£57,000 including VAT) was due on 29 September 2010. The tenant sent an email to the managing agents on 24 September 2010 stating that a payment had been made for the ‘outstanding rent for the premises totalling £8563.01’ and requesting confirmation that it was the correct amount. The break was ineffective as the tenant had not paid a full quarter’s rent.
