While there were considerable difficulties in the way of the future development proposed by the landlord, in that planning permission had not been obtained and there were issues surrounding the right to vacant possession of part of the development site, the Vice Chancellor was satisfied that there was a real possibility (as distinct from a probability) that the landlord would redevelop the site. The court ordered the inclusion of a general redevelopment break clause exercisable at any time on 6 months' notice. The tenant was adequately protected by the Act in that on exercising the break the landlord would still have to establish ground (f) and that could involve a considerable time lag.
