A basement flat, previously occupied by a resident caretaker who subsequently left and was not replaced, was then sold off on a long lease. The tenants' contributions to the cost of maintenance was fixed in the lease at 1/11th and it was held there was no legal obligation on the landlord to reduce the contribution, even though the total of the fixed percentages added up to 100 per cent without the caretaker's flat (although the landlord did in fact offer to reduce the tenants' proportion to 1/12th to recognise what was fair).
