On the facts, proposed works aimed at upgrading a hotel from a 2-star to a 4-star establishment did not satisfy the requirements of ground (f). The proposed works compromised the removal of stud partition walls, subdivision of rooms and installation of new rooms to create en suite facilities. The judge held that the works did not amount to reconstruction within the first limb of ground (f) and did not amount to substantial work of construction within the second limb of ground (f).
The Court of Appeal refused to interfere with the judge's decision, holding that the decision on ground (f) is a decision in the nature of an evaluation with which the appellate court should be slow to interfere.
