The judge held that the intention to run a restaurant business from the premises has been proved and concluded that he would find in favour of the landlord 'only if' the undertaking was given. The Court of Appeal held that the undertaking had been properly accepted as one of the factors that the judge had taken account for its evidential value in establishing intention.
A Liberian shipping company with no experience of running a restaurant was able to establish an intention to run a restaurant under ground (g) through an agreement with an experienced restaurateur manager.
