The Court of Appeal allowed a tenant's appeal against the inclusion in the new tenancy of a qualified covenant against assignment subject to a proviso to the effect that in the event of the tenant contemplating an assignment it would first offer to surrender the term for no consideration. There were no special reasons justifying so novel and burdensome a departure from the terms of the original lease that contained a standard qualified covenant against assignment without any such proviso.
