Summary

A valuer was instructed by a prospective borrower to value property and to send his report to the lender's solicitor. The valuer did this, knowing that the lender was likely to rely on the report in deciding whether or not to lend. It was held that the valuer owed the lender a duty of care.

This case, which was many years ahead of its time, was quickly declared wrong by the Court of Appeal in another case; however, it was restored to favour by the House of Lords in Hedley Byrne & Co Ltd v Heller & Partners Ltd (1964).
