Biography

Richard Hayes was called to the Bar in 1995. Richard has broad experience representing and advising PLCs, lenders and leading national charities, as well as small family companies and individuals with experience in the Court of Appeal; the High Court (Chancery and Queen's Bench Divisions); the TCC and the County Courts as well as specialist tribunals such as the Leasehold Valuation Tribunal.

He has particular expertise in property and commercial disputes, in particular:

Property mortgages: (experienced acting for lenders or borrowers); guarantees; disputes as to beneficial ownership and claims under the Trusts of Land and Appointment of Trustees Act 1995; all aspects of landlord and tenant (both business and residential with experience in relation to all major regimes of statutory protection); enfranchisement; rights of way and other easements; restrictive covenants; boundary and title disputes.

Commercial: most forms of business/contractually based claim; sale of goods and supply of services; agency; corporate and personal insolvency; director and shareholder disputes. Experience in employment disputes, in particular wrongful and unfair dismissal and issues arising from termination such as the enforcement of restrictive covenants.

Professional Negligence: for claimants and defendants, in particular in relation to solicitors and valuers with particular expertise in relation to limitation issues.
